Welcome to Talk Now Telehealth, a service providing mental health therapies and via video and telephone conferencing throughout Australia and New Zealand. By using our services, you agree to comply with and be bound by the following terms and conditions.

“Service” refers to the mental health  services provided via our web and mobile app.
“User” refers to any individual who uses our Service.
“Provider” refers to any licensed professional providing mental health through our Service.
“Platform” refers to the Talk Now Telehealth web and mobile applications.

3. Eligibility

To use our Service, you must be at least 16 years old or have the consent of a parent or legal guardian if you are a minor. You must also reside in Australia or New Zealand.

4. User Responsibilities

Users are responsible for:

– Providing accurate and complete information during registration.

– Maintaining the confidentiality of their account and password.

– Ensuring they have the necessary equipment and internet access to use the Service.

– Using the Service in accordance with all applicable laws and regulations.

7. Appointment Cancellations and Refunds

– Users may cancel appointments up to 48 hours before the scheduled time without incurring any charges. The $50 deposit will be refunded to the User at the time of cancellation. – Cancellations made less than 48 hours before the scheduled appointment will incur a fee of $50. The $50 deposit will be withheld by the Provider and NOT be refunded to the User.

8. Payment Terms

– Users agree to pay a $50 deposit at the time of booking. – Users agree to pay all fees associated with the Service as outlined during the booking process at the end of their consultation. – All payments must be made through the payment methods provided on our Platform. – Failure to pay fees may result in the suspension or termination of your account.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Talk Now Telehealth or its licensors and is protected by copyright, trademark, and other intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes.

10. Limitation of Liability

To the fullest extent permitted by law, Talk Now Telehealth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: – Your use or inability to use the Service. – Any unauthorized access to or use of our servers and/or any personal information stored therein. – Any interruption or cessation of transmission to or from our Platform. – Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Platform by any third party. – Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Platform.

11. Indemnification

Users agree to indemnify, defend, and hold harmless Talk Now Telehealth, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney’s fees) arising from: – Your use of and access to the Service. – Your violation of any term of these Terms and Conditions. – Your violation of any third-party right, including without limitation any copyright, property, or privacy right. – Any claim that your use of the Service caused damage to a third party.

12. Modifications to the Service and Terms

Talk Now Telehealth reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Talk Now Telehealth may also modify these Terms and Conditions from time to time. Continued use of the Service following any such changes shall constitute your acceptance of the new Terms and Conditions.

Terms and Conditions for Therapists

1. Introduction

Welcome to Talk Now Telehealth. These Terms and Conditions (“Terms”) govern the relationship between Talk Now Telehealth (“Company”) and the therapists (“Therapist” or “You”) who provide mental health service via our web and mobile app throughout Australia and New Zealand.

2. Definitions

“Service” refers to the mental health service provided through the Talk Now Telehealth platform.
“Platform” refers to the Talk Now Telehealth web and mobile applications.
“User” refers to any individual receiving services through the Platform.
“Provider” refers to the Therapist providing services through the Platform.

3. Eligibility and Licensing

– Therapists must hold a valid and current professional license to practice in their respective field within Australia and/or New Zealand. – Therapists must provide proof of their registration, credentials, qualifications, and professional indemnity insurance before being allowed to offer services on the Platform. – Therapists must comply with all relevant local, state, and national regulations and standards of practice.

4. Responsibilities of Therapists

– Provide services in a professional, ethical, and legally compliant manner. – Maintain the confidentiality and privacy of Users in accordance with applicable laws and Company policies. – Ensure accurate and complete documentation of all User interactions and treatment plans. – Attend scheduled appointments on time and provide timely notifications in case of cancellations or rescheduling. – Use the Platform’s secure communication channels for all User interactions. – Report any concerns or issues regarding the Platform or User interactions to the Company promptly.

5. Service Delivery

– Therapists agree to provide services through video and telephone conferencing as facilitated by the Platform. – Therapists must ensure they have the necessary technical equipment and reliable internet connection to deliver services effectively. – In the event of technical difficulties, Therapists must make reasonable efforts to reschedule the session or find an alternative method of communication.

6. Payment and Fees

– Therapists will receive payment for their services as outlined in the contract agreement with Talk Now Telehealth. – Payments will be processed through the Platform, and Therapists are responsible for any applicable taxes. – Therapists must provide accurate banking information for payment processing and update this information as necessary.

7. Confidentiality and Privacy

– Therapists must adhere to all applicable privacy laws and regulations, including but not limited to the Australian Privacy Principles (APPs) and the New Zealand Privacy Act. – Therapists must use the Platform’s secure communication channels for all User interactions to ensure the confidentiality and security of User information. – Any breach of User confidentiality must be reported to the Company immediately.

8. Intellectual Property

– All content and materials provided by Talk Now Telehealth remain the intellectual property of the Company. – Therapists may not use, reproduce, or distribute any Company materials without explicit permission.

9. Limitation of Liability

– To the fullest extent permitted by law, Talk Now Telehealth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the provision of services by Therapists. – Therapists agree to indemnify and hold harmless Talk Now Telehealth from any claims, damages, or liabilities arising from their provision of services through the Platform.

10. Termination

– Either party may terminate this agreement at any time with written notice. – Upon termination, Therapists must cease using the Platform and return any Company property or confidential information.

11. Dispute Resolution

– Any disputes arising from these Terms shall be resolved through good faith negotiations. – If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Australia and New Zealand.

12. Amendments

– Talk Now Telehealth reserves the right to amend these Terms at any time. Therapists will be notified of any changes, and continued use of the Platform constitutes acceptance of the amended Terms.

13. Governing Law

– These Terms shall be governed by and construed in accordance with the laws of Australia and New Zealand.
